Terms & Conditions – Introductory Agency
- Role of Sure2Clean
Sure2Clean operates solely as an introductory agency, introducing self-employed cleaners to clients. Sure2Clean does not provide cleaning services and is not the employer of any cleaner introduced.
- Vetting of Cleaners
Sure2Clean takes reasonable care when interviewing, vetting, and reference-checking cleaners added to its database. However, Sure2Clean does not guarantee the performance, conduct, suitability, or ongoing availability of any cleaner.
- Insurance & Liability
3.1 Public Liability Insurance
For clients’ peace of mind, Sure2Clean maintains Public Liability Insurance with cover of no less than £5,000,000 in respect of cleaners it introduces.
A copy of the insurance certificate is available on request.
3.2 Scope of Insurance
The Public Liability Insurance provides cover for accidental damage, theft, or malicious damage caused by a cleaner introduced by Sure2Clean, subject to the insurer’s terms, conditions, exclusions, limits, and excess.
3.3 Insurance Exclusions
Clients will not be covered by Sure2Clean’s insurance where:
- the cleaner was not introduced by Sure2Clean.
- the terms of this agreement have been breached.
- damage arises from bleach or strong chemical products.
- the claim falls outside the insurer’s policy scope.
3.4 Insurance Excess
All claims are subject to an insurer excess of £250.
The client accepts responsibility for the first £100 of this excess.
For valid claims accepted under this agreement, Sure2Clean will contribute up to £150 towards the excess.
3.5 Limitation of Liability
To the fullest extent permitted by law, Sure2Clean shall not be liable for:
- any loss or damage exceeding the limits of its Public Liability Insurance.
- any consequential or indirect losses.
- loss of income, loss of profit, or business interruption.
- failure of a cleaner to attend, perform services, or meet expectations.
- the quality, standard, or outcome of cleaning services.
- loss or damage arising from dishonesty or collusion by a cleaner unless caused by Sure2Clean’s proven negligence.
Nothing in this agreement limits liability for death or personal injury caused by negligence or affects statutory consumer rights.
3.6 Liability Cap
Sure2Clean’s total liability under this agreement shall not exceed the total agency fees paid by the client in the preceding 12 months, or the limit of its Public Liability Insurance, whichever is lower.
3.7 Keys
Ownership of and responsibility for client keys remains strictly between the client and the cleaner. Sure2Clean accepts no liability for lost keys or losses arising from failure to return keys.
3.8 Time Limit for Claims
All claims relating to damage, loss, or dissatisfaction must be reported to Sure2Clean within 48 hours of the relevant service being carried out. Claims reported after this period will not be accepted.
3.9 Client Insurance
Clients must maintain appropriate household or business insurance to cover liabilities to the cleaner and shall provide evidence of such insurance upon reasonable request.
- Cleaner Status & Client Obligations
4.1 Self-Employed Status
All cleaners introduced are self-employed contractors. The client engages the cleaner under a contract for services agreed directly between them.
4.2 Scope of Services
The client agrees directly with the cleaner:
- what services are to be provided.
- the frequency, duration, and standard of work.
4.3 Payment
The client shall pay the cleaner directly at the agreed hourly rate. Sure2Clean does not handle wages or employment payments.
4.4 Cover Cleaners
Where a cover cleaner is required due to illness or holiday, the client must contact Sure2Clean. Cover cleaners are not guaranteed or automatically provided.
4.5 Recovery of Fees
The client shall be responsible for all reasonable costs incurred by Sure2Clean in recovering unpaid agency fees.
- Continuity & Quality
5.1 No Guarantee of Continuity
Sure2Clean does not guarantee the continued availability of any particular cleaner.
5.2 No Quality Guarantee
Sure2Clean does not guarantee the quality, suitability, or outcome of cleaning services carried out by cleaners introduced.
- Non-Solicitation of Cleaners
If, within 12 months of termination, the client (or any associate) directly or indirectly employs or contracts with a cleaner introduced by Sure2Clean, the client shall pay Sure2Clean £1,000 as a genuine pre-estimate of loss.
- Termination
7.1 Termination by Client
Clients are requested to give one calendar months’ notice to terminate this agreement.
7.2 Termination by Sure2Clean
Sure2Clean may terminate this agreement with one calendar month’s written notice.
7.3 Immediate Termination
Either party may terminate immediately where the other commits a serious breach of these terms.
- Force Majeure & Jurisdiction
Neither party shall be liable for failure or delay caused by events beyond reasonable control.
This agreement shall be governed by English Law, and the parties submit to the exclusive jurisdiction of the English courts.
